This didn't need 3D to work. It long ago passed the kids-wear-out-the-DVD-rewatching-it test.
It may be harder nowadays to dazzle audiences with fancy visual effects, but Monsters, Inc. 3D proves that smart, imaginative storytelling still does the trick every time.
Most of the charm of "Monsters Inc." comes from its vocal cast.
If history is any guide, you and your family - whether young or old - will probably want to see "Monsters University" over and over.
The movie itself stands up well, even from an adult, two-dimensional perspective.
Its reassuring message is more relevant than ever.
Another chance to see Pixar's most dazzling premise, now spruced up with a third dimension.
Now in 3D, the filmmakers have created a wonderful reality - the reality of Monstropolis, which like the worlds of Oz and Pleasantville, whisk us far, far away on a magic carpet of fantasy
A shrewdly timed reminder of Pixar's early, heady days, when the animation powerhouse could do no wrong.
There's really little reason to check out Monsters, Inc. 3D in... well, 3D, rather than going for a good old-fashioned 2D screening instead.
It does well, but not brilliantly: an amusing trifle from a studio whose best work still lay ahead of it.
Not quite a Pixar classic, but funny, witty and visually spectacular enough to be enjoyed again on the big screen.
Monsters, Inc. continues a positive 3D trend for the company, who appear to be selecting their upgraded titles wisely, choosing features that benefit from the additional depth.
Not even the opportunistic 3D-ification can squander the pure delight of the film's meticulously detailed world of ragtag creatures.
[A] sparkling cartoon ...
John Lasseter and the Pixar crew know how to turn shared human feelings and experiences into strange and delightful animated features. "Monsters, Inc." is one of their most solid efforts.
A typically engrossing Pixar effort...
Cute, kid-friendly monster movie; may scare sensitive kids.
Though "Monsters, Inc." relies more on spinning-plates plot than its Pixar peers, this romp retains the charm and heart of the animation juggernaut's forte - adding extra to ordinary hopes, in this case leaving great impressions on the kids we love.
A charming cartoon classic coming courtesy of a successful collaboration by the good folks at Disney and Pixar.

There are people that enjoy the winter and then there are those who dread every moment, fear every weather report and loathe the cold. While on the surface this may simply seem like a matter of opinion, I believe that there is something greater that separates these two groups. Winter lovers tend to get out and appreciate the season for what it offers?crisp, cool air and a chance to enjoy a landscape that looks so very different than it does in the warmer months.
You may be thinking that this is all well and nice, but it still won?t get you out from under your cozy covers to ?enjoy? a twenty degree day. What if I told you that not taking advantage of getting outdoors and exercising during the winter is the reason you find yourself wishing you could just hibernate??Experts agree that getting physical activity in the winter?especially outdoors?boosts your mood, reduces the symptoms of seasonal affect disorder and helps prevent winter weight gain. All you need is 30-45 minutes and you could be on your way to enjoying, not just enduring, the winter.
Put on your hiking boots: Lace up some water proof boots and go for a hike or at least a walk. Take advantage of areas that are generally over grown in the summer- possibly even right in your back yard.
Try snow shoes: Designed to prevent you from sinking into the snow, snow shoes provide a strenuous workout if you venture to follow your own path, or a less difficult but equally beautiful way to enjoy the winter if elevation isn?t your thing. Not sure where to go? Your local golf course may make be a great place. If you live near a ski area take advantage of the groomed trails for free! Call local ski shops to find out about renting snow shoes.
Think like a kid: Just get out there! Start playing around, throwing snow balls and even go sledding (walking the sled up the hill is sure to work your legs).
If I really can?t get you to go outside: There are many opportunities to work out without even leaving your house. For a low monthly membership you can have access to over 170 exercise videos through Workouts on Demand. Ranging from beginner to expert, Sparkpeople.com ?allows you to string together a series of videos to create the workout you are looking for. I also recommend checking out iTunes, which includes many downloadable apps such as Fitness Buddy ($.99) that offers more than a thousand workouts to download to your phone. Lastly, if a Nintendo Wii or other game console has made it into your home, purchase a fitness game or other active game that will get you (and your kids!) moving.

Sony upstaged most during its press event last night by announcing a Ultra HD 56-inch OLED, but if you thought there wouldn't be competitors, you're mistaken. At the CES day one opening Keynote, Panasonic showed off its very thin (about a half inch thick) 56-inch Ultra HDTV OLED. Like Sony's there's no price or availability, but we suspect it'll still fall into the, if-you-have-to-ask category.

LANDOVER, Md. (AP) ? Russell Wilson raced ahead to throw the final block on Marshawn Lynch's go-ahead touchdown run, and the Seattle Seahawks finally had a victorious road show.
Robert Griffin III's knee buckled as he tried to field a bad shotgun snap, leaving the Washington Redskins an offseason to worry about their franchise player's health.
The last rookie quarterback standing in the NFL playoffs is Wilson ? the third-round pick who teamed with Lynch on Sunday to lead the Seahawks to a 24-14 victory over the Griffin and the Redskins.
Lynch ran for 132 yards, and Wilson completed 15 of 26 passes for 187 yards and ran eight times for 67 yards for the Seahawks, who overcame a 14-0 first-quarter hole ? their biggest deficit of the season ? and will visit the top-seeded Atlanta Falcons next Sunday.
"It was only two touchdowns, but it's still a big comeback and in this setting and the crowd, it's a marvelous statement about the guys resolve and what is going on," Seattle coach Pete Carroll said. "It's not about how you start but how you finish."
Seattle will be riding a six-game winning streak, having left behind any doubts that the team can hold its own outside the Pacific Northwest. The Seahawks were 3-5 on the road in the regular season and had lost eight straight road playoff games, the last win coming in December 1983 against the Miami Dolphins.
The day began with three rookie quarterbacks in the playoffs, but No. 1 overall pick Andrew Luck was eliminated when the Indianapolis Colts lost 24-9 to the Baltimore Ravens earlier in the day.
Lynch's change-of-direction, 27-yard touchdown run ? with Wilson leading the way with a block on safety Madieu Williams near the goal line ? and a 2-point conversion gave the Seahawks a 21-14 lead with 7:08 remaining.
"Marshawn always tells me, 'Russ, I got your back, no matter what,'" Wilson said. "So I just try to help him out every cone in a while when he gets downfield."
Then came the play that essentially put the outcome to rest.
On the second play of the Redskins' next possession, Griffin's heavily braced right knee buckled badly as he tried to field a bad shotgun snap on a second-and-22 at Washington's 12-yard line. He lay on the ground, unable to recover the ball as the Seahawks pounced on it.
Griffin walked off the field under his own power, but the Redskins announced he would not return. After a few minutes, Griffin walked back to the sideline and watched the end of the game. The extent of the injury was not immediately known.
Griffin was playing in his third game since spraining his right knee about a month ago against the Baltimore Ravens, and he had been looking gimpy since tumbling backward following an ill-advised sidearm throw in the first quarter.
Nevertheless, he stayed in the game. Redskins coach Mike Shanahan said he didn't pull Griffin because the quarterback wanted to continue.
"I think I did put myself at more risk," Griffin said. "But every time you get on the field, you're putting yourself on the line."
Griffin was scheduled for an MRI to determine the extent of the injury.
Having recovered the fumble, the Seahawks kicked a short field goal to give them the insurance they needed. Fellow rookie Kirk Cousins, subbing for Griffin, was unable to rally the Redskins in the final minutes.
Griffin, the No. 2 overall pick and last year's Heisman Trophy winner who set several rookie quarterback record this year, finished 10 for 19 for 84 yards with two touchdowns and one interception. He also had five carries for 21 yards, including a laboring 9-yard run that made him look 32 years old instead of 22.
The loss ended a seven-game winning streak for the Redskins, who recovered from a 3-6 start to win the NFC East.
The Redskins opened the game threatening to make a mockery of the NFL's top scoring defense. Simple toss-to-the-right stretch plays netted 8, 9 and 18 yards for Alfred Morris in an 80-yard drive, and tight end Logan Paulsen barreled into linebacker Malcolm Smith after a catch to highlight a 54-yard drive.
Both possessions ended with 4-yard touchdown passes: one to Evan Royster for his first NFL TD catch and the other to Paulsen. The Redskins led 14-0 in the first quarter against a team that allowed a season-low 15.3 per game in the regular season, but Griffin had tweaked the knee on that second drive.
The Seahawks responded by getting Lynch involved more and scoring on three consecutive drives to pulled within a point at halftime. Steven Hauschka, who injured his left ankle during the first half and had to relinquish kickoff duties, nevertheless sandwiched field goals of 32 and 29 yards around a 4-yard touchdown pass from Wilson to Michael Robinson.
The Seahawks were poised to take the lead on the opening drive of the second half, moving the ball to 1-yard line with a pair of nice runs by Lynch and a leaping catch by Golden Tate.
But Lynch fumbled on second-and-goal from the 1, the ball popped loose and was recovered by defensive lineman Jarvis Jenkins. Then, on their next drive, the Seahawks drove to Washington's 28 before a sack forced a punt ? rather than a long field goal attempt by an injured kicker.
With the Redskins' offense struggling, however, the Seahawks had more chances to take the lead ? and finally did on the 79-yard drive capped by Lynch's touchdown run.
The playoff meeting between the two teams was the third, but first outside Seattle. The Seahawks won 20-10 in January 2006, and 35-14 in January 2008. Those were the last two postseason games played by the Redskins.
Seattle had outscored opponents 193-60 in its final five games of the regular season. But they were 3-5 on the road and had lost eight straight road playoff games. Their only road playoff win came in their first postseason road game, Dec. 31, 1983, at Miami.
And now they have another.

WASHINGTON (AP) ? Former Nebraska Sen. Chuck Hagel is a contrarian Republican moderate and decorated Vietnam combat veteran who is likely to support a more rapid withdrawal of U.S. troops from Afghanistan.
As President Barack Obama's probable nominee for defense secretary, Hagel has another credential important to the president: a personal relationship with Obama, forged when they were in the Senate and strengthened during overseas trips they took together.
Hagel, 66, has for weeks been the front-runner for the Pentagon's top job, four years after leaving behind a Senate career in which he carved out a reputation as an independent thinker and blunt speaker. An announcement on his nomination was expected Monday.
"I do think Obama's done a good job overall. There are a lot of things I don't agree with him on; he knows it," Hagel told the foreign policy website Al-Monitor last March.
Wounded during the Vietnam War, Hagel backed the Iraq war, but later became a fierce and credible critic of the Bush administration's war policies, making routine trips to Iraq and Afghanistan. He opposed President George W. Bush's plan to send an additional 30,000 troops into Iraq ? a move that has been credited with stabilizing the chaotic country ? as "the most dangerous foreign policy blunder in this country since Vietnam, if it's carried out."
While Hagel supported the Afghanistan war resolution, over time he has become more critical of the decade-plus conflict, with its complex nation-building effort.
Often seeing the Afghan war through the lens of his service in Vietnam, Hagel has declared that militaries are "built to fight and win wars, not bind together failing nations." In a radio interview this year, he spoke broadly of the need for greater diplomacy as the appropriate path in Afghanistan, noting that "the American people want out" of the war.
In an October interview with the online Vietnam Magazine, Hagel said he remembers telling himself in 1968 in Vietnam, "If I ever get out of this and I'm ever in a position to influence policy, I will do everything I can to avoid needless, senseless war."
If confirmed by the Senate, Hagel would succeed Defense Secretary Leon Panetta. Panetta has made it clear he intends to leave early this year, but has not publicly discussed the timing of his departure. He took the Pentagon job in July 2011.
At the same time, Obama has nominated one of Hagel's former Senate colleagues, Democrat John Kerry of Massachusetts, for the job of secretary of state.
To political and defense insiders, Obama's preference for Hagel makes sense.
The former senator shares many of the same ideals of Obama's first Pentagon leader, Republican Robert Gates. When Obama became president in 2009, he asked Gates to remain as defense secretary. Both Hagel and Gates talk of the need for global answers to regional conflicts and an emphasis on so-called soft power, including economic and political aid, to bolster weak nations.
"A Hagel nomination signals an interest in, and a commitment to continuing a bipartisan approach to national security," said David Berteau, senior vice president at the Center for Strategic and International Studies.
He said Hagel's two terms in the Senate, before he retired in 2009, spanned the latter years of the post-Cold War military drawdown and the post-Sept. 11 buildup. "From a budget point of view he has seen both ends of the spectrum and that gives him a good perspective to start from."
Hagel's possible selection has been met with initial praise from key members of the Senate, including the chairman of the Senate Armed Services Committee, Sen. Carl Levin, D-Mich., who said Hagel would be "terrific."
But Republicans have said he faces tough questions, with South Carolina Sen. Lindsey Graham declaring Hagel would be "the most antagonistic secretary of defense towards the state of Israel in our nation's history."
Hagel has criticized discussion of a military strike by either the U.S. or Israel against Iran. He also has backed efforts to bring Iran to the table for talks on future peace in Afghanistan.
"The appointment of Chuck Hagel would be a slap in the face for every American who is concerned about the safety of Israel," said Matt Brooks, executive director of the Republican Jewish Coalition.
But the pro-Democrat, pro-Obama National Jewish Democratic Council issued a statement Monday saying it trusts that Hagel "will follow the president's lead of providing unrivaled support for Israel," including "leading the world against Iran's nuclear program."
Hagel often straddled party lines and had some high-profile dustups with his Republican colleagues.
In 2008, he criticized GOP vice presidential candidate Sarah Palin, saying she lacked foreign policy credentials and that it would be "a stretch" to consider her qualified to become president. His wife, Lilibet Hagel, endorsed Obama in his first run for president. Hagel also was mentioned as a possible candidate for Pentagon chief when Obama was first elected.
As defense secretary, Hagel would preside over the withdrawal of combat troops from Afghanistan and the waning days of the war, and would direct some of the steepest cuts in Pentagon spending in years. His task would be to restructure a pared down military that can step away from the grinding wars of the past 11 years and refocus on a swath of regional challenges from Syria, Iran and North Korea to terrorism in Africa and the defense buildup in the Pacific.
His experience and his allies on Capitol Hill will work to his benefit.
"Certainly his name coming forward is one I'm very open to," said Sen. Bob Corker, R-Tenn., who served with Hagel on the Senate Foreign Relations Committee. "I had good relations with him while he was in the Senate. Certainly (he's) a veteran and someone who also spent a lot of time around the world understanding the relations other countries have with the U.S. and vice versa."
Defense analyst Loren Thompson, of the Virginia-based Lexington Institute think tank, said Hagel knows the political system and is known for thinking outside the box, which would help as budget cuts move forward.
"He's a veteran who understands how Congress works and has stayed plugged in to developments in defense policy," Thompson said. "He is not tied to the status quo and will think creatively about how to manage America's military forces."

LOS ANGELES (TheWrap.com) - Anna Faris has joined the ranks of big-screen talent taking on small-screen projects.
"The House Bunny" and "Scary Movie 4" star Faris has been cast to star in "Mom," the CBS pilot from "Two and a Half Men" and "The Big Bang Theory" executive producer Chuck Lorre, individuals familiar with the situation told TheWrap on Friday.
Faris will play a newly sober single mom who attempts to pull her life together in California's Napa Valley. (Which could pose a problem, given the region's prodigious wine output.)
The half-hour, multi-camera comedy, which has received a pilot production order from a spec script, is executive-produced by Lorre and Eddie Gorodetsky (who's served as a producer on "The Big Bang Theory" and "Two and a Half Men"). The pair are also writing, along with Gemma Baker ("Two and a Half Men"). Baker is also a producer on the project.
Chuck Lorre Productions is producing in association with Warner Bros. Television.

It is that time of the year where we all start to look ahead to the new year, perhaps making some New Year resolutions that are sure to last for at least a few days. To switch things up a bit, several years ago I contacted a number of my industry contacts to ask them what they wish for moving into the New Year. ?See, for example, Industry Insiders Make Patent Wishes for 2012. This has become rather popular and persisted. This year we have a host of industry experts who participated. Over and over again the theme that emerges is that the patent bashing will stop.
So what is your wish for 2013?
Without further ado, here are the wishes of some elite members of the patent and innovation community for 2013.
Nicholas P. Godici
Executive Advisor,?Birch, Stewart, Kolasch & Birch LLP
Former Acting Director, USPTO
My wish for 2013 is that the American public take a more balanced view of our patent system instead of the ?our patent system is broken? view encouraged by some of the mainstream media. We need to recognize that our patent system has been successful for over 200 years in incentivizing researchers and investors. Sure, we can and should look for ways to improve the system including reducing ?shakedown? litigation based on patents of dubious validity, but overall a strong patent system that protects the rights of patent owners has led to unprecedented innovation in the fields of medicine and our ?at your fingertips? technology of today. We need to step back and ask ourselves the question, would we have the lifesaving drugs or the information technology available today, or the jobs those industries have produced, without the incentive provided by our patent system?
In the coming year I hope that the public, the media, and the SCOTUS, will take a more informed view of our patent system and recognize the value of a strong patent system and the good it has produced for all of us.
Additionally, I want to wish all of my friends and colleagues in the patent community a healthy and happy new year.
?
Manny Schecter
Chief Patent Counsel, IBM
I wish for greater understanding of the patent system outside of the patent community.? With increasing frequency I read public commentary which clearly demonstrates a lack of such understanding yet calls for sweeping changes to the patent system or dismantling it altogether.? Such calls influence public perception and degrade the integrity of the system.? Contrary to this misinformation, the patent system continues to be an engine for innovation and job growth.
The patent system is not perfect, but we should not act hastily or make radical changes that put our innovation economy at risk.? Instead, we need to expose the flaws of the system and carefully craft solutions targeted to minimize unintended consequences.? We are only just beginning to understand the impact of the America Invents Act and much more will be learned in the coming years.? Hopefully, we can all agree to steadily and deliberately strive to improve the quality, accuracy, clarity, certainty, and transparency of our patent system.
?
Bob Stoll
Drinker Biddle
Former Commissioner for Patents, USPTO
I would wish for world peace, but since I am not a contestant in a beauty pageant, I will focus more specifically on perfecting the patent system, even if the goals seem equally unattainable. I would hope that we could find ways to get our decision makers to realize that limiting patent eligible subject matter in the areas of software, diagnostic methods, personalized medicine and isolated sequences, to name a few, harm the US economy in the very industries where we lead the world. Instead we should enhance our focus on improving patent quality so that overly broad patents do not issue. In what would be the rare circumstance where bad patents do issue, those improvidently granted patents should be easily invalidated.
I wish that we could harmonize our patent processes worldwide to eliminate duplicative efforts so that we need only one comprehensive search and examination that accurately determines patentability.
I wish we could further simplify the laws, rules and procedures to reduce costs and make the system more user friendly while providing a fair outcome.
Finally, I also wish that we could find ways to get our inventors the ?rock star? status they deserve in our society. That would help encourage all kids to aspire to invent and productively focus the next generation to find even more ways to improve the human condition.
?
Stephen Kunin
Partner,?Oblon Spivak
Former Deputy Commissioner for Patent Examination Policy, USPTO
My patent wishes for the new year are:
1. Financial stability for the USPTO to enable it to achieve its pendency reduction, service to the public and quality goals and the selection of a new Director to succeed Dave Kappos who will build on the impressive legacy he has created.
2. A pro-patent pendulum swing in the Supreme Court?s and Federal Circuit?s decision-making that will better help promote innovation and job growth in the?U.S.
3. An upturn in global economies that will stimulate investment in research and development to promote innovation, create jobs and improve the standard of living throughout the world.
4. Increased respect for and improvement in the enforcement of intellectual property rights throughout the world.
5. A solution to the debt crisis that will avoid burdening our children and grandchildren as well as generations to come.
?
Trevor Lambert
Lambert & Lambert
My wish is for inventors.? That they continue to drive growth in the economy through innovation of all kinds like they have for centuries in this country.? Further, that they tap into the many resources, professionals, and inventor groups to educate themselves to become better equipped to tackle their new venture with professionalism.? Finally, that inventors learn to grow, adapt, modify, revise and essentially improve their innovations as they critically assess feasibility, market factors and consumer feedback.
?
Joe Allen
Joseph Allen & Associates
Former Staffer to Senator Birch Bayh (D-IN)
Feature Contributor to IPWatchdog.com?
My wish is that the media, the public and our political leaders recognize that a relative handful of innovators creating new products encouraged by the patent system make life better for all of us. These entrepreneurs (French for ?risk taker?) deserve our admiration, not envy and resentment.? Our only chance for meeting the tremendous economic, social and public health challenges staring us in the face is by creating the conditions for innovation? and then getting out of the way so it can grow.? The Founding Fathers had good reason to put the intellectual property system in the very first Article of the Constitution.? Lincoln said that the patent system ?adds the fuel of interest to the fires of genius? yet too many seem determined to dampen the fuel by attacking the very nature of the system.? We would do well to remember how our current prosperity was created? and how quickly it is slipping away.
Finally, now the we see that the Mayans were wrong about the world ending, I hope that my Pittsburgh Pirates seize the reprieve and get above .500 this year.? Twenty years of futility is quite enough, thank you. Let?s go Bucs!

As the effects of the Leahy-Smith America Invents Act and its implementing regulations ? recognized as the first major overhaul to the patent system in almost 60 years ?? continue to change how we practice, my wish for 2013 is that the jurisprudence of ?divided infringement? becomes clearer.? The reality is that, in the wake of the Federal Circuit?s August 2012, 6-5 en banc consolidated decision in Akamai/McKesson, the value of many (software) patents containing methods claims remains far too uncertain.? Hopefully, in 2013, the SCOTUS provides more definitive guidance on the ?single entity rule? and its applicability to indirect and direct infringement.? Also, I wish all of my IP community colleagues a happy, healthy and prosperous new year.

As 2012 draws to a close, so does the very successful tenure of David Kappos as Director of the USPTO. Mr. Kappos stepped into the USPTO leadership position at a very difficult time.? He assembled an excellent administrative team, dealt with many formidable obstacles, and made remarkable progress in setting the USPTO on a constructive course.? Progress at the USPTO has been measurable not only in objective terms. I believe that most practitioners would acknowledge a noticeable improvement in the culture of the Office and in the interaction of Office personnel with the public. Congratulations to all concerned. My wish for 2013 is that the Office remains on this path under the leadership of whoever may take the reins after Mr. Kappos.
As we enter the new year, we should take a moment to reflect and appreciate?the significant progress that has been made in the past year to improve the?US Patent System. The USPTO is the engine that drives innovation. Patents?level the playing field for independent inventors, allowing them to compete?with far larger companies, and provide the incentive for investing in the?further development and commercialization of their brilliant ideas. We have?experienced economic turbulence over the past several years, but we can?count on innovation, and the jobs that are created through this, to lead us?to stable ground.
At the end of the day, we all want a system that rewards the first inventor?who files their invention, and provides greater speed and certainty to the?process. We want a system that is responsive to the applicant and minimizes?the time necessary to examine an application. My patent wish for 2013 is?that the IP community comes together and works hand-in-hand with the USPTO?to usher in the AIA and the positive effects it will have on the patent?system.

I wish that: (1)?we ?survive? the changeover from the current ?first to invent??regime to the new AIA ?first to file? regime when March 16, 2013 arrives; (2) the ACLU/PubPat gets ?coal in their stocking? when SCOTUS?decides the AMP v. Myriad case; (3)?we get a new director of the USPTO that can at least half fill?the shoes of the departing David Kappos. (4)?Congress fulfills their ?promise? in the AIA (Abominable Inane?Act) to not ?raid? the USPTO user fee coffers and to insure that the USPTO?is fully funded from those user fees; (5) we get some more patent law experienced judges on the Federal?Circuit;. (6)?Congress cease enacting inane legislation in the patent area; and (7)?SCOTUS keeps their collective judicial noses out of the patent?law area (faint hope though that is) and let the Federal Circuit be the?primary arbiters of patent law jurisprudence as was intended by Congress?back in 1982.

I don?t have any wishes for our patent system in 2013, because I don?t think our system is broken. The USPTO provides independent inventors and entrepreneurs with fantastic tools to protect their intellectual property from infringement and level the playing field. These tools are affordable and accessible, and they?re even more beneficial when they are fully understood. If you take the time to educate yourself, you can begin to create a wall of protection.
I?ve seen firsthand how well the system works more than once.?I?m confident that I was able to sell my company because of my extensive and thorough patent profolio. It made the decision for the other company to buy my company easy: it was explicitly clear that this was my idea alone, and I had already invested a lot in it.?And years ago, I sued a large toy company in federal court. It took us three years, but we eventually settled three weeks before we were set to go to trial. Good attorneys are so valuable. You need them to write your patents and manage the process. In court, it was really a prizefight about words. I discovered that. My intellectual property rights helped defend me. And that?s why they?re worth every penny ? especially if you end up in up in court.

There will be an ample amount written about the major patent litigations, valuations and the America Invents Act. ?I want to focus my 2013 wish list on the relationship between the patent system and the public ? the entrepreneur, like me, who is driven to achieve the American dream by starting her own business, the investors in those business and the employees who are the engine of America?s economic growth.
My company, Article One crowdsources patent research.? Our platform is the world?s largest patent research community.? Our global community is 25,000 plus researchers from 160 countries. ?Article One is honored to work members of the public who have self-selected to research on our platform.?? AOP feels fortunate to represent the unique view of researchers worldwide.? We interact with our researchers on an educational level about the patent system and the identification of prior art globally, as well as the technical mapping of claim language to prior art.
Members of the public are subject to the patent system regardless of their knowledge of the law, such as when they are faced with a patent litigation.??Patent infringement is strict liability.??Infringement is found and damages applied even in cases where an infringer has no knowledge or intention of infringing.
Thus, my wish for 2013 is for those with authority in the patent system, judges, US Patent Office and other government officials, and thought leaders to assess sanctions against those who would misuse our litigation system and clarify legal standards. ?Judges are in the best position to assert Rule 11 sanctions to those litigants which use patent litigation as a business model, relying on the cost of defense rather than the quality of the patent asserted. ?The identification of thise abusers is not limited to their commercialization status, but is best judged by their factual conduct and Rule 11 assessment on a case by case basis. ?Under Director Kappos? strong leadership, the USPTO now provides new opportunities to improve patent quality in creating portfolios as well as post grant proceedings to determine the merits of issued patents. ?My hope is that the leadership succeeding Director Kappos can continue his excellent direction and accomplishments. ?With this focus,??the patent system can better serve members of the public subject to the obligations of the patent system and the economic fuel that is entrepreneurship.
