Disney's stock shines even as earnings decline

SAN FRANCISCO (AP) ? Disney won over more fans on Wall Street with its latest quarterly performance, despite a slight drop in its earnings.

The downturn announced Tuesday was less pronounced than the modest dip analysts anticipated as Walt Disney Co. digested higher programming costs at its ESPN television network and dealt with a less appealing line-up of home video releases in its movie studio. Higher expenses for distributing box-office hits such as "Lincoln" and "''Wreck-It-Ralph" also created a drag during the holiday-season quarter.

The Burbank, Calif. company offset some of those problems with an advertising upturn at its ABC network, higher spending at its theme parks and a reversal of an operating loss in its video games division.

It was good enough to set the stage for Disney's stock to hit a new high in Wednesday's trading. The shares gained $1.48, or 2.7 percent, to $55.77 in Tuesday's extended trading after the release of the financial results. If the stock reaches that level Wednesday, it will top its previous peak of $54.87, which the shares touched just last week.

When Disney does well, it tends to lift spirits throughout the stock market. That's because Disney is one of the 30 companies that comprise the influential Dow Jones industrial average and also is part of the Standard & Poor's 500 index that serves as a basis for many investment funds. Both the Dow Jones and S&P indexes are nearing their all-time highs reached in 2007.

Although he didn't make a concrete forecast, Disney CEO Robert Iger painted a bright picture for analysts during Tuesday conference call.

"We're confident about the year ahead, as well as our ability to create continued long-term growth," Iger said.

Most analysts have been optimistic about Disney's prospects for several reasons.

Cable and TV satellite providers are expected to pay Disney higher fees to carry its channels on their systems. Disney also is opening new theme parks and adding more attractions such as "Cars Land," which helped bring in more crowds and boost spending at its southern California resort during the latest quarter.

On the movie studio side, Disney plans to release several potential crowd pleasers later this year, including a prequel to "The Wizard of Oz," a sequel to the 2001 animation hit "Monsters Inc." and a new take on "The Lone Ranger" starring Johnny Depp. Meanwhile, sequels are already in the planning stages for three of the most successful film franchises in Hollywood history: "Pirates of the Caribbean," ''The Avengers" and "Star Wars." Disney just picked up the rights to the latter franchise in late December when the company completed its $4.06 billion acquisition of Lucasfilm Ltd.

The next installment in the "Star Wars" saga, due out in the summer of 2015, will be directed by acclaimed science-fiction film maker J.J. Abrams. In Tuesday's conference call, Iger also confirmed Lucasfilm will make at least two other films outside the "Star Wars" saga. The first two peripheral projects are being overseen by Lawrence Kasdan, who wrote "The Empire Strikes Back" and "Return of the Jedi," and Simon Kinberg, whose credits include writing "X-Men: The Last Stand."

Looking even further ahead, Disney has lined itself for a big payday from Netflix Inc. by licensing its latest theatrical releases to the Internet video subscription service beginning in 2016. That deal was reached in early December.

Disney earned $1.38 billion, or 77 cents per share, during its fiscal first quarter, a three-month stretch that ended Dec. 29. That compared with net income of $1.46 billion, or 80 cents per share, in the same period in 2011.

Excluding certain charges and one-time gains, Disney said it would have earned 79 cents per share. On that basis, the results exceeded the average estimate of 76 cents per share among analysts surveyed by FactSet.

Revenue climbed 5 percent from the previous year to $11.3 billion ? about $130 million above analyst predictions.

Feather Fight EP by Justin Martin & Eats Everything ? Hypercolour

Justin Martin and Eats Everything seem sensible bedfellows. The Dirtybird regular and Bristolian tunesmith have had stellar 2012s, so when they were booked in to play the West Country town?s Motion night last year it seemed fitting that a collaboration was on the cards. Borne from a seven day period ahead of their gig, the Feather Fight EP are a pair of no-nonsense housers that reach back to the garage era and flood the dancefloor with unapologetic big-room sounds. The third point of the triangle is Hypercolour, the UK label that seems to discard pigeonholes with gusto, and this release seems a comfortable companion to the ravey work that Groove Armada so noisily arrived with last summer.

The title track?s entry point is vanilla enough: shuffling snare, finger-click hits, and a slowly climbing note that only slightly challenges any lead-in template. But it?s the elongation of this note, to almost ear-splitting heights, that begins to point the way, dropping into a rasping lead pattern and wobbling bass note, before the female vocal arrives and its true nature is revealed. Despite the pump, it?s actually a fairly sparse arrangement, but when the elements are as raucous as these, no embellishment is needed. Partner ?Harpy? also begins relatively unthreateningly, its echoing vocal and strings hovering over kick-free filtered percs, but once the low end arrives, you can almost smell the dry ice. The drop is fierce; a monstrous, muscular bass bubbles under a regular foghorn announce, all 90s Friday-night lasers and wet-look gel, but just as it threatens to become a one-shot deal, the harp and vocal float back in and release the pressure, and the glorious cycle begins again.

Spencer Parker?s Work Them Records reflects his uncluttered attitude to electronic music. Regular vinyl shopping to unearth and delight in non-digital gems, energetic tracks from the deepest house to the most ardent techno, all focussed on one thing: the dancefloor. For its fifth release, he?s captured one of his current favourites to bring their wide-ranging and organic sounds to the table: Pittsburgh Track Authority. The trio?s first and brilliant EP in 2013 follows twelves on Argot and Uzuri, and is a neat representation of the expansive borders of Parker?s own record box, taking in the spectrum from driving, bleepy techno to nervous, shuffling bass-driven house.

?Strenf? opens to dense kicks, sparse hats and distorted, coiled chords, before analogue stabs and a repeating note punctuate the foreground, like the centre stripes on an endless road at night, ever-present and pointing the way. There?s energy brimming from all sides, as chattering fx and organ-like leads enter the fray, and elements emerge and dissipate, but the pace never slackens. ?The Standard? trades in bright chords and off-centre drums to joust with the baseline?s steadfast groove, a study in barely-contained force arguably more sparse than ?Strenf?. Its throbbing mood is offset by ?Missile 1??s tension-releasing electro-tinged workout. Containing a centred sinuous medley of rasping b-line and rich stabs, with shakers and echoed rim shots adding colour, the contrast is measured and welcomed. Closing out is ?It?s Time?, a stuttering, nervy weave of angry low-end rasps, murmured, chopped vox, and competing mids, punching through and retreating as if in competing formations. Heavy.

FAA mandates safety checks for older Piper planes

(AP) ? The Federal Aviation Administration is requiring inspections on tens of thousands of older model Piper airplanes to check cables that control tail surfaces.

The FAA is posting a directive in Monday's Federal Register, prompted by reports of failures in the cable assembly which direct a plane's nose. The rule requires inspections and parts replacement as needed, to correct what the FAA calls an "unsafe condition."

The requirement applies to certain Piper aircraft that are more than 15 years old.

A Piper Aicraft Inc. spokeswoman says it's aware of three incidents that led to the directive. The privately held Vero Beach, Fla., company, which makes some of the most popular general-aviation planes, is cooperating with the FAA.

The Wall Street Journal first reported the move, saying it affects about 34,000 aircraft.

England's King Richard III found after 500 years

LEICESTER, England (Reuters) - A skeleton with a cleaved skull and a curved spine entombed under a car park is that of Richard III, scientific tests confirmed, solving a 500-year-old mystery about the final resting place of the last English king to die in battle.

Richard, depicted by William Shakespeare as a monstrous tyrant who murdered two princes in the Tower of London, was killed fighting his eventual successor Henry Tudor at the Battle of Bosworth Field in central England in 1485.

In one of the most significant archaeological discoveries of recent times, a team from the University of Leicester said evidence showed that a skeleton found last year during excavations of a mediaeval friary under a parking lot in the city was indeed that of Richard.

After a detailed academic presentation focusing on the life, wounds and physique of Richard III, the lead archaeologist on the project, Richard Buckley, announced his conclusion to cheers and applause.

"It's the academic conclusion of the University of Leicester that beyond reasonable doubt the individual exhumed at Grey Friars in September 2012 is indeed Richard III, the last Plantagenet king of England," Buckley said.

Academics said DNA taken from the body matched that of Michael Ibsen, a Canadian-born furniture maker in London who genealogists said was the direct descendant of Richard's sister, Anne of York.

The skeleton showed signs of injuries consistent with wounds received in battle; a bladed implement appeared to have cleaved part of the rear of the skull while a barbed metal arrowhead was found between vertebrae of the skeleton's upper back.

While the findings may solve one riddle about Richard, the last Plantagenet king of England remains a complex figure whose life, made famous by Shakespeare's history play, deeply divides opinion among historians in Britain and abroad.

(AP) ? Hollywood's strange awards season continues with another ceremony that could firm up a big Oscar win for Ben Affleck's "Argo."

The Directors Guild of America hands out prizes Saturday night in Los Angeles in what typically is a final blessing for the film that goes on to win best-picture and director at the Academy Awards.

Affleck can go only one-for-two at the Oscars, though. He's up for the film honor at the guild awards, and "Argo" is looking like the best-picture favorite at the Oscars on Feb. 24. But the director's branch of the Academy of Motion Picture Arts and Sciences overlooked him and several other key filmmakers for an Oscar directing slot.

The guild and Oscar directing lineups usually match up closely, but they have little in common this season, with only Steven Spielberg for "Lincoln" and Ang Lee for "Life of Pi" nominated at both shows.

Along with them and Affleck, the guild nominated Kathryn Bigelow for "Zero Dark Thirty" and Tom Hooper for "Les Miserables." At the Oscars, Spielberg and Lee are joined in the directing category by Michael Haneke for "Amour," David O. Russell for "Silver Linings Playbook" and Benh Zeitlin for "Beasts of the Southern Wild."

With 12 Oscar nominations, Spielberg's Civil War saga initially looked like the Oscar favorite over such other potential favorites as "Argo," ''Les Miserables" and "Zero Dark Thirty," since films generally have little chance of winning best picture if they are not nominated for best director. Only three films have done it in 84 years, most recently 1989's best-picture champ "Driving Miss Daisy," which failed to earn a directing nomination for Bruce Beresford.

But Affleck's "Argo," in which he also stars as a CIA operative who hatches a bold plan to rescue six Americans during the hostage crisis in Iran, has been sweeping up all the major awards since the Oscar nominations. "Argo" won best drama and director at the Golden Globes and top film honors from the Screen Actors Guild and the Producers Guild of America.

Many of the same film professionals who vote in guild awards also cast ballots for the Oscars. If Affleck wins at the Directors Guild awards, it will be a strong sign that "Argo" has the inside track for the best-picture Oscar.

Saturday's honors aren't all about "Argo," though. Milos Forman ("One Flew Over the Cuckoo's Nest," ''Amadeus") will receive the guild's lifetime-achievement award, and the director's union also will hand out prizes for television, documentary and commercials. Kelsey Grammer returns as host for the second-straight year.

Affleck may have a bit of newcomer's edge at the guild, where he's the only first-time nominee. Spielberg has won the guild prize a record three times, for "The Color Purple," ''Schindler's List" and "Saving Private Ryan." Lee has won twice, for "Crouching Tiger, Hidden Dragon" and "Brokeback Mountain," while Bigelow won three years ago for "The Hurt Locker" and Hooper won two years ago for "The King's Speech."

A win for Affleck would nick the guild's record as a strong forecast for the eventual directing recipient at the Oscars. Only six times in the 64-year history of the guild awards has the winner there failed to follow up with an Oscar. It would be No. 7 if Affleck wins Saturday, since he's not up for best director at the Oscars.

Peer loyalty might play in Affleck's favor at the Oscars. The acting branch in particular, the largest block of the academy's 5,900 members, might really throw its weight behind "Argo" because of Affleck's directing snub. Actors love it when one of their own moves into a successful directing career, and Affleck ? who's rarely earned raves for his dramatic chops ? also delivers one of his best performances in "Argo."

Affleck has had no traction in acting honors this season, and he's joked that no one considered it a snub when he wasn't nominated for best actor. So a best-picture vote for "Argo" might be viewed as making right his omission from the directing lineup and acknowledging what a double-threat talent he's become in front of and behind the camera.

A best-picture prize also would send Affleck home with an Oscar. The award would go to the producers of "Argo": George Clooney, Grant Heslov and Affleck.

But it's not as though Affleck has never gotten his due at Hollywood awards before. He and Matt Damon jump-started their careers with 1997's "Good Will Hunting," for which they shared a screenplay Oscar.

Odds Favor Pullback vs. Ongoing Vertical Ascent

Since the November 2012 low, the S&P 500 has gained 166 points ? a big move. From a risk/reward perspective, a fair question is ?are the odds better for the S&P 500 to tack on another 63 points or do the odds favor the market giving back 63 points?? While we are not calling for a 63 point pullback, we believe the answer is the ?63 point give back? is the higher probability outcome.

Cyclical Stocks Losing Momentum

According to the AMEX, the Morgan Stanley (MS) Cyclical Index:

?Is designed to measure the performance of economically sensitive industries within the U.S. economy and detect shifts in investor sentiment. The CYC Index comprises 30 stocks from over 25 industries, including automobiles, metals, papers, machinery, chemicals and transportation.?

When the MS Cyclical Index is outperforming the broader market, it reflects optimism about the economy. When the index begins to lose steam relative to the S&P 500, it is indicative of slowing bullish momentum about future economic outcomes. As we explain in detail at the 6:28 mark of the video below, the MS Cyclical Index has been hinting at a possible reversal relative to the broader market, which in turn is concerning for stock bulls.

Below is an updated version of the MS Cyclical Index?s performance relative to the S&P 500. Recently, reversals within the blue trend channel (see A1 & B1) have been followed by weakness in the S&P 500 (see above A2 & B2). If the pattern holds, the turn down this week below C1 hints at some corrective action in the stock market.

Fear Index Says ?Be Careful?

The VIX is also known as the Fear Index. When the S&P 500 is outperforming the VIX, ?risk-on? tends to be in fashion. Conversely, when the VIX begins to outperform stocks, the odds of entering a ?risk-off? or corrective phase increase. As shown below, the S&P 500 relative to the VIX recently broke above resistance in a manner consistent with ?risk-on?. Since then, the breakout is beginning to look more like a ?fake out?. As of Thursday morning, the VIX has beaten the S&P 500 by roughly 10% this week, which raises a yellow flag for stock bulls.

The Battle of Inflation vs. Deflation

Stock market corrections tend to coincide with increasing concerns about future economic growth. Prolonged periods of economic weakness are deflationary events since waning demand causes asset prices to fall. When investors are more concerned about inflation vs. deflation, the ratio of silver (SLV) to Treasuries (TLT) tends to rise. When investors are more concerned about economic weakness and deflation, the ratio below tends to fall (see chart below).

With the Fed running the printing presses at breakneck speed, fears of inflation have had the upper hand in recent weeks. If the chart above breaks out to the upside, our concerns about a stock market correction would lessen. If the ratio begins to fall into the ?Deflation Fears? area above, our concerns about stock prices would increase.

What Goes Up Can Come Down ? Fast

As we noted January 25, when markets begin to advance in a near-vertical manner, it becomes more and more difficult to manage risk. Charts that ?go straight up? can also ?come straight down?. If the NASDAQ breaks below the blue support lines shown below, a fairly quick drop back toward 3060 could be in the cards. Markets tend to fill ?white space? on charts once bullish momentum deteriorates.

After noting an improving risk/reward profile on November 19, 2012, we began buying back stocks. Last week, as the risk/reward profile was becoming increasingly less favorable we booked profits in small-caps (IWM), transportation (IYT), mid-caps (MDY), emerging markets (EEM), technology (QQQ), and the broad market (SPY). The market can quickly erase gains that have taken months to accrue. By converting the gains to cash, they cannot be taken away by the market. Thus, with profits booked we are in better control relative to our next moves. If the market corrects, we can redeploy our profits at lower levels. If the market begins behaving in a more favorable manner, we can always buy back in when the risk/reward ratio is more favorable.

Could stocks continue to march higher in a straight line? Absolutely, positively yes, but it is not likely. We are not calling a top; just trying to invest prudently and protect our gains.
